UMBRA x Three Crowns Strategic Insight 2024 Seminar

As part of our commitment to advancing legal excellence and to give back to our clients, UMBRA, in collaboration with Three Crowns LLP, successfully hosted the Strategic Insight 2024 Seminar: Strategy in Handling Cross-Jurisdictional Complex Commercial and Industry-Specific Disputes. This event – held in partnership with the Indonesia Judicial Research Society, the Indonesian Corporate Counsel Association, and ILUNI FHUI – brought together esteemed justice of the Supreme Court of Indonesia, arbitrator, academician, policymakers, and legal professionals to address the dynamics, intricacies and evolving challenges in dispute resolution.

 

The seminar opened with keynote speeches by Septian Hario Seto, Executive Secretary of the National Economic Council, and Andre Abraham, Head of the Legal Bureau of the Ministry of Investment and Downstream Industry/BKPM. Their insights on Indonesia’s economic and regulatory landscapes set the stage for a day of impactful discussions.

 

The program featured three highly engaging sessions moderated by Melati Siregar and Kirana Sastrawijaya.

 

The first session explored strategies for resolving investment and finance disputes, with panelists consisting of our Managing Partner, Pramudya Oktavinanda, Senior Partner Putu Raditya, Daryl Chew, Managing Partner of Three Crowns LLP’s Singapore office, and Fajar Restu Sonjaya, Director of Alternative Dispute Resolution Services of LAPS-SJK. This session also highlighted the importance of efficacy of court litigation and arbitration as the last resort in commercial disputes and having an exit clause in commercial agreements.

 

The second session addressed the implications of PERMA 3/2023 and the urgency of revising Indonesia’s arbitration and alternative dispute resolution law, with distinguished speakers such as Lucas Prakoso, Supreme Court Justice of Civil Chambers, Dwi Agustine Kurniasih, Associate Expert Legal Analyst of National Legal Development Agency (BPHN), Marianna Sutadi, arbitrator and former Deputy Chief Justice of the Supreme Court, Prof. Yetty Komalasari Dewi from Law Faculty of the University of Indonesia, and Perdana A. Saputro, SVP Division, Head of Holding Corporate Legal of MIND ID. This session also emphasized the importance of honoring the agreement to arbitrate and discussed the contribution of PERMA 3/2023 to support the enforcement of arbitral awards in Indonesia.

 

The third session delved into dispute resolution in construction, energy, and ESG sectors, The discussion included valuable insights from Yusuf Didi Setiarto, PLN’s Director of Legal and Human Capital Management, Reza Permana Topobroto, General Counsel, VP Legal & Compliance of Telkomsigma and Shaun Pereira, Counsel at Three Crowns LLP. The third session also discussed the drivers of disputes in energy transition and the importance of dispute mitigation and dispute avoidance in commercial agreements.
