Successfully Representing a Property Developer in Resisting Annulment of Arbitral Award
Our Litigation & Alternative Dispute Resolution team scores their first win in 2024! The team, led by Melati Siregar and supported by Nikki Krisadtyo and Ramadinan Saptara, successfully resisted an annulment application of a BANI award before the Denpasar District Court.
The annulment application was brought against an award that we had successfully obtained last year. The counterparty filed the annulment application on allegations that forged documents were used in the arbitration and cited other reasons outside the conditions for annulment under the Arbitration Law. We successfully convinced the court that the allegations are groundless and the court rejected the annulment application in full. Under the Arbitration Law and the newly-issued Supreme Court Regulation No. 3 of 2023, which introduces new provisions on arbitration and arbitration-related procedures, the court’s decision is final and binding and is not subject to any appeals.
