Focus Group Discussion With PT Pertamina Hulu Indonesia on the implications of Indonesia’s new Criminal Code (KUHP Baru) and Criminal Procedure Code (KUHAP Baru)

UMBRA had the privilege of collaborating with PT Pertamina Hulu Indonesia (PHI) to facilitate a Focus Group Discussion on the implications of Indonesia’s new Criminal Code (KUHP Baru) and Criminal Procedure Code (KUHAP Baru), which came into effect on 2 January 2026.

 

This session involved Dr. M. Fatahillah Akbar, S.H., LL.M. — Lecturer at Criminal Law Department, Universitas Gadjah Mada, who walked participants through the foundational principles of both laws and what they mean for each stage of criminal proceedings. Building on that foundation, our Senior Partners Melati Siregar and Reggy Firmansyah, brought the discussion closer to home, exploring what corporate criminal liability looks like in practice, how companies in the upstream oil & gas sector can manage their exposure, what the new framework means for advocates and in-house counsel on the ground, as well as several criminal offenses particularly relevant to the oil and gas industry.

 

Navigating a new criminal law regime is no small undertaking, especially for corporations operating in highly regulated sectors. We are proud to have supported PHI’s legal team in building the knowledge and readiness needed to face these changes with confidence.

 

The session closed on a warm note, with participants and speakers continuing the conversation over iftar; a fitting end to a productive and collegial afternoon.
