Legal Preventive Program PT Pertamina Hulu Indonesia

The enactment of Indonesia’s new Criminal Code (KUHP) and new Criminal Procedure Code (KUHAP) marks a significant shift in the country’s legal landscape, bringing with it expanded obligations and heightened exposure to criminal liability for corporations — particularly those operating in high-stakes sectors such as upstream oil and gas.

 

It is against this backdrop that PT Pertamina Hulu Indonesia took a proactive step by organizing a Legal Preventive Program seminar titled “Peningkatan Upaya Preventif terhadap Risiko Hukum Pidana di Lingkungan Regional 3 Subholding Upstream Group Pasca Pemberlakuan KUHP Baru dan KUHAP Baru.” The seminar was designed to bridge the gap between legal and operational functions, equipping both in-house legal teams and operational personnel with a shared understanding of the criminal law risks they may encounter in day-to-day business activities, and the concrete steps that can be taken to mitigate them.

 

We are proud to share that our Senior Partner and Head of UMBRA’s Natural Resources Practice Group, Reggy Firmansyah, was invited to speak at this important forum. As part of the seminar, Reggy led an in-depth discussion covering two pivotal topics: Corporate Criminal Acts and Corporate Criminal Liability, and the Authority, Rights, and Obligations of Advocates and In-House Counsel. The session provided a comprehensive examination of how organizations operating within the upstream oil and gas sector can understand and navigate their legal responsibilities under the new legislative framework.

 

Complementing this, Reggy also spoke on the intersection of business relations and risk mitigation in the upstream oil and gas industry in light of the newly enacted KUHP and KUHAP, offering practical insights on how companies can strengthen their preventive legal strategies to reduce exposure to criminal liability.
