Successfully Representing a Property Developer in a IDR260 billion Property Acquisition Dispute at BANI
We are delighted to share the recent success of UMBRA’s Litigation & Alternative Dispute Resolution team in representing a prominent property developer in a significant BANI arbitration case involving the sale and purchase of a beachfront hotel in Bali, valued at approximately IDR260 billion.
We represented our client as the respondent and filed a counterclaim against the claimants, who were the sellers of the property. The counterclaim sought, among other things, the refund of the booking fee that had been paid to the claimants.
We successfully convinced the tribunal that payments are conditional upon registration of the property, and the claimants cannot demand any further payments without evidence of good title. In the end, the tribunal rejected the claimants’ claim in full and awarded a full refund of the booking fee to our client.
