We are delighted to announce the recent success of our Litigation & Alternative Dispute Resolution team in representing a power project owner in dismissing a claim by a subcontractor at the Indonesian National Arbitration Board (BANI), ensuring that the project owner is not in default under its project financing documents worth billions of dollars.
The arbitration was initiated by a subcontractor against the contractor, project owner, and other related parties. Despite a tight deadline due to Eid holidays, with the utmost work dedication, our team, led by Melati Siregar with the support of Nikki Krisadtyo and Astrid Adelya Natasya, successfully obtained an interlocutory award dismissing our client as a party – saving invaluable time and cost in dealing with this issue.
As the arbitration proceeding affected various contracts of the client as part of a complex project financing, we also helped the client in navigating through the various steps necessary to ensure that the issues relating to the arbitration are contained and do not adversely affect the client’s business and the entire project. Our team worked closely together with our M&A, Restructuring & Special Situations and Project, Energy & Infrastructure Practice Group team led by Pramudya A. Oktavinanda and Kirana Sastrawijaya for a seamless and streamlined service to the client.
