Force Majeure in Contract Drafting – Universitas Diponegoro

On 12 and 13 May, our Litigation and Alternative Dispute Resolution Senior Associate, Nikki Krisadtyo, was invited as a guest lecturer at Diponegoro University. Nikki gave two lectures on force majeure in the context of cross-border contract drafting. As a dispute resolution lawyer, Nikki not only deals with force majeure once a dispute has arisen, but also assists in drafting force majeure clauses. To give a well-rounded explanation, Nikki explained the dos and don’ts in force majeure clauses and provided examples of how force majeure is implemented and interpreted in practice. The class was closed with a lively discussion on force majeure in the context of Covid-19, with the key takeaway being that the existence of Covid-19 in and of itself is not sufficient to claim force majeure.
