The “Positive List” Under the Newly Issued Presidential Regulation No. 10 of 2021 on Investment Business Activities – A Real Game Changer!

The long anticipated Presidential Regulation No. 10 of 2021 on Investment Business Activities was finally issued on 2 February 2021, officially replacing the previous Negative Investment List under Presidential Regulation No. 44 of 2016. The types of businesses that are subject to foreign ownership restriction are further reduced from 48 business fields (per the previous Presidential Regulation Draft) into 46 business fields – even better news, indeed! There are no other material changes from the PR Draft as analyzed in our previous client alert.
